These terms of service (“Terms”) govern your access and use of our services, products, features, apps, API’s, technologies, software, ads, commerce services, and any information, text, links, graphics, photos, images, audio, video, or other materials or arrangements of materials uploaded, downloaded, or appearing on the Services (collectively referred to as “Content”).

UPDATING THE TERMS OF SERVICE
We work constantly to develop new features and improve our services and from time to time we may need to update these Terms.

We also retain the right to create limits on use and storage at our sole discretion at any time. We may also remove or refuse to distribute any Content on the Services, suspend or terminate users, and reclaim usernames without liability to you.
CONTENT
You alone are responsible for your use of the Services and the Content you provide and publish on TownFish. Once published, it cannot always be withdrawn, and you assume all risks associated with the Content. We advise that you only provide Content you are comfortable sharing.
You retain your rights to any Content you submit, publish and display on or through the Services. Your Content belongs to you and not us.
By submitting, publishing, or displaying Content on or through the services you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content.
You give exclusive permission for us to store, copy, and share your Content with other service providers that we work with and who support our services.
You can end this license at any time by deleting your Content on TownFish or by deactivating your account.
CONTENT RESTRICTIONS
You expressly agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the Platform any of the following:
Any message, data, information, text, music, sound, photos, graphics (including trademarks), code or any other material (“Content”) that is false, unlawful, misleading, libellous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing or advocates harassment of another person, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable
Content that is patently offensive to the online community, such as content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual
Content that would constitute, encourage, promote or provide instructions for the conduct of an illegal activity, criminal offense, give rise to civil liability, violate the rights of any party in any country in the World or that would otherwise create liability or violate any local, state, national or international law.
Content that provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
Content that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party. In particular, content that promotes an illegal or unauthorised copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity, including TownFish;
Unsolicited promotions, mass mailings or “spamming”, transmission of “junk mail”, “chain letters,” political campaigning, advertising, contests, raffles, or solicitations;
Content containing commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes;
Private information of any third party, including, without limitation, surname (family name) addresses, phone numbers, email addresses, Social Security numbers, and credit card numbers.
Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
Viruses, corrupted data or other harmful, disruptive or destructive files;
Content that is unrelated to the topic of the Interactive Area(s) in which such Content is posted; or
Content or links to content that, in the sole judgment of the Owner,
– violates the previous subsections herein,
– is objectionable,
– restricts or inhibits any other person from using or enjoying the Interactive Areas or the Site, or
– may expose Us or our affiliates or its users to any prosecution harm or liability of any type.
TownFish does not assume any responsibility or liability for any Content posted, stored or uploaded by You or any third party, or for any loss or damage thereto, nor is TownFish liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity You may encounter. As a provider of interactive services, TownFish is not liable for any statements, representations or Content provided by its users in any public forum, personal home page or other Interactive Area.
You warrant that all Content You post on the Platform is your property and/or that you have the unfettered permission of the owner of that Content to post it on the Platform.
We reserve the right to remove Content that violates these Terms of Service including copyright or trademark violations, impersonation, unlawful conduct, or harassment.
ACCOUNT SUSPENSION AND TERMINATION
We want TownFish to be a place that welcomes users, where they feel free to express their thoughts and opinions, and where they can share and connect with other members.
If we determine that you have clearly, seriously, or repeatedly violated our terms or policies, including the Community Guidelines we might restrict your access to the services, or even suspend or disable your account permanently.
We may also be required by law to terminate this contract and disable your account and where appropriate we will notify you about these changes.
You may deactivate your account at any time and these Terms will then terminate as an agreement between you and us.
LIMITATIONS OF LIABILITY
We cannot guarantee that the Services will always function without disruptions, delays, or imperfections. Provided we have acted with reasonable skill and care, we do not accept responsibility for: losses not caused by our breach of these Terms or otherwise by our acts; losses which are not reasonably foreseeable by you and us at the time of entering into these Terms; any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content posted by others that you may encounter on our Services; and events beyond our reasonable control.
We are engaged to provide data to you but we have no control over the nature or quality of the data which is input by the Users on TownFish or collected from our other sources and therefore we accept no responsibility for all and any acts defaults errors or omissions contained within the data.
Neither party enters this Agreement on the basis of or relying on any representation, warranty or other provision except as expressly provided in writing and all other terms implied by statute or common law are excluded so far as legally permitted. Liability or remedy for innocent or negligent misrepresentation is excluded.
Liability is neither limited nor excluded for death or personal injury, or otherwise where it would be unlawful to do so.
You must keep your password secure and any information you provide us with correct and up to date and indemnify us against all losses arising from misuse of your password by a third party or losses arising from your having given to us incorrect or out of date information
By using the Services you agree that TownFish, it’s affiliates, related companies, officers, directors, employees, agents representatives, partners and licensors, liability is limited to the maximum extent permissible in your country of residence.
ENDING THESE TERMS
You may end your legal agreement with TownFish at any time by deactivating your account and discontinuing your use of the Services.

1. ABOUT US
TownFish is a hyperlocal social networking and voucher discovery platform for UK (and Wordwide) locations. Content posted to any of the website newsfeeds is immediately viewable and searchable by anyone around the world and via online search engines. There are some non-public ways to communicate on TownFish with other members including via Direct Messages.
When you register for membership on TownFish you must provide us with an email address, your date of birth, and your postal town in order to create an account. If you are registering as a business, agency or organisation you must also tell us your business type. You can choose to share additional information with us like your phone number, street address, and on your public profile you can choose to add information about your gender, work location, personal interests, occupation, current employer, country of origin, and university studied. This data is not mandatory or a condition for using TownFish or any of the services, you can choose to add or delete this data at any time. We use the information you provide for things like keeping your account secure and recommending you to relevant members, events, local deals, and other types of ads.
2. INFORMATION WE COLLECT WHEN YOU JOIN
You don’t have to create an account on TownFish to view public content posted in the location newsfeeds or to view public profile pages. If you chose to create an account, you must provide us with some personal data so that we can provide our services to you.
The personal data we may collect from you includes:
We use your postal town location to link you directly with associated newsfeeds on TownFish relevant to the same postal town location and also linking you with surrounding locations you might choose to interact in. You may also be assigned a different set of privileges to other members who are not associated with your postal town location.
Unless you choose to add it to your profile description, your email address will not be shown anywhere on TownFish publically. It can be seen by TownFish administrators in our Content Management System, in our databases and in third-party software services we use for the purpose of providing you with the Services.

6.1 SOCIAL NETWORK INFORMATION
If you use Facebook to sign up for an account, or log in to TownFish (or later connect your Facebook account to your TownFish account) you authorise Facebook to share your personal information with us, including your picture, name and email address.
6.2 LOCATION INFORMATION
In additional to asking you for your business or residential postal location when you register on TownFish, we also ask for permission to use the location services on your mobile device. We may collect and store data about your location such as your current precision position, or in geo locations in which your mobile device enters or exits. We do this so we can operate and personalise our services with more relevant recommendations to do with your current location such as local deals, events, featured items, and updates.
The difference when using a mobile device
There is no real difference except that as you move about, we monitor your location to make sure that we are giving you the best service.
With most mobile devices you can turn the location settings off – if you don’t want us to track you.
We also send updates in the form of push notifications to your phone when various changes and updates occur that are associated with your account, profile page, and the content you have published on TownFish.
6.3 INFORMATION WE COLLECT AND MONITOR WHEN YOU ARE LOGGED INTO YOUR ACCOUNT

6.4 PUBLIC INFORMATION
Most activity on TownFish is viewable publicly, including your profile information, and the content you post in the forum newsfeeds. This includes certain information about your posts like the date and time of the post. Other information that is shown publicly are the list of TownFish member you choose to follow, recommendations and photos you have posted , the posts you have Liked, the events you have said you are ‘Going’ to (calendar marked), and also any comments, replies, and comments you have Appreciated or been given Appreciations by other TownFish members.
6.5 PAYMENT INFORMATION
You may be asked to provide us with payment information, including your credit or debit card number, card expiration date, CVV code, and billing address, in order to purchase goods and services provided via TownFish, in particular when making purchases using our mobile coupons and vouchers. We use this payment information to process transactions you have approved and also to detect fraud.
6.6 CHANGE OF PURPOSE
We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.
If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

Membership is not available to anyone under 16 and if you try to join and we find out, we will stop your membership immediately. We ask that you are honest with us so that we can help you.
If you do try and join and we cancel your membership, we may well keep a note of your IP and email addresses to stop you registering again until you are able.
12. HOW YOU CONTROL THE INFORMATION YOU SHARE WITH US

No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
